The One Kenya Alliance is demanding that Sabina Chege be compelled to return the money she was paid while holding the position of Deputy Minority Whip.

In addition, the alliance is calling on the Supreme Court to nullify the position.

In his decision, the Speaker of the National Assembly, Mr. Moses Wetang’ula, recognized Jubilee as the party overseeing parliamentary affairs and even appointed Ms. Chege as the Deputy Minority Whip.

However, the One Kenya Alliance claims that appointing Ms. Chege to the position while she was a member of the alliance is an abuse of public funds and, therefore, a violation of the Constitution.

“The complainant alleges that the respondent’s recognition of Jubilee as the party overseeing Parliament demonstrates the removal of that party from the coalition of the applicants without following the established procedure,” said Mr. Wycliffe Oparanya, the chairman of the national council of the One Kenya Alliance.

The alliance contends that such recognition is procedurally unfair and hinders access to justice, constituting a breach of the Constitution.

The opposition party also argues that the recognition of Jubilee as the party overseeing Parliament, sidelining other parties, is discriminatory and contrary to the Constitution.

On April 13, 2023, the One Kenya Alliance wrote to Mr. Wetang’ula urging him to submit his resolution to remove Ms. Chege as the Deputy Minority Whip.

At that time, Mr. Wetang’ula hinted that he had received a request from the opposition faction for Jubilee to be recognized as the party overseeing Parliament.

Mr. Oparanya suggested that internal conflicts within the Jubilee party regarding different factions can only be resolved through a National Delegates Conference of the party, and to his knowledge, there has been no such conference.

“Therefore, the Jubilee party cannot be recognized as the party overseeing Parliament because that would undermine the coalition agreement between parties,” he said.
