The co-director of Kilindini Warehouse (K) Limited, Omar Salesh Said, has accused Victor Arara Were, a fellow director of the company, of plotting to defraud him of his shares in the company.

Mr Were appeared before Milimani chief magistrate Lucas Onyina and faced two charges: conspiracy to defraud and falsifying a document.

Specifically, Were allegedly forged a notification of change of directors and secretaries to show that Said was no longer a director of the company, which he knew to be false.

Were’s two co-accused, Awdh Swaleh Said and Swaleh Awadh Saleh, who are Said’s brothers, were not present for plea taking and a warrant has been issued for their arrest.

The prosecution argued that Were is a flight risk and therefore objected to his release on bail. Senior state prosecutor Anderson Gikunda stated that Were was brought before the court under a warrant of arrest after failing to appear in court on April 4, 2023.

The prosecution also claimed that Were has been evading the police for the last month since the warrant was issued against him. However, Were’s lawyer argued that the accused had a fixture bond and was not a flight risk.

“The first accused Awdh Swaleh Said is a brother to the complainant… the second accused, Swaleh Awadh is a nephew to the complainant…Prosecution alleges that the accused persons are likely to compromise the case and we don’t take the allegations lightly, they are reputable persons … There are only four witnesses in the charge sheet, the complainant and three police officers… they cannot be able to compromise police officers,” argued the lawyer.

The lawyer also stated that the co-accused were reputable persons who were unlikely to compromise the case, and that there were only four witnesses in the charge sheet, including the complainant and three police officers, who could not be compromised.
