The High Court has issued an injunction preventing the police from arresting or detaining two MPs involved in the investigation into the financing of the Gen Z protests.
On July 31, Embakasi North MP James Gakuya and Embakasi Central MP Benjamin Mejja Donk were taken from Parliament buildings for questioning about the issue. Both MPs are supporters of Deputy President Rigathi Gachagua.
Additionally, several of Gachagua’s aides have been interrogated in relation to the protest funding.

In response, Gakuya and Mejja Donk have sought legal protection against arrest. Justice Chacha Mwita has granted an order halting any arrest or detention of the two lawmakers.
Further instructions will be provided on September 17.
Justice Mwita’s order, issued on August 5, 2024, states: “A conservatory order is hereby issued, restraining the respondent, their agents, or servants from arresting, detaining, confining, pursuing, or otherwise interfering with the petitioner’s liberty in connection with the allegations at hand.”
A week ago,MP James Gaguya and his Embakasi Central counterpart Benjamin Gathiru alias Mejja Donk were released after questioning at the DCI headquarters on Kiambu Road.
The duo had been brought in Wednesday evening for questioning over their alleged sponsorship of the recent anti-tax protests that rocked the country and hit global headlines.
The legislators are the latest allies of Deputy President Rigathi Gachagua to be questioned over the alleged bankrolling of the Gen Z-led protests.
Speaking after their release, Gaguya dismissed the accusations terming them as nothing more than a witch hunt.
“Anybody with any evidence of any facts of any mistake we did should come very clear and tell us ‘this particular day, you finance ABCD’” Gakuya said.
