Court Directs Ex- CS Rotich’s Dams Scandal Case To Continue

According to a report by the Director of Public Prosecutions (DPP), the court upheld the accusations by the prosecution who is the DPP and ruled for the hearing to continue.

The Milimani High Court on Thursday dismissed a petition filed by the former Treasury Cabinet Secretary, Henry Rotich challenging charges levelled against him in a fraud case.

In the application, the Ex-CS had denied accusations of involvement in the multi-billion Arror and Kimwarer Dam scandal that saw a loss of billions of shillings in dubious circumstances.

According to a report by the Director of Public Prosecutions (DPP), the court upheld the accusations by the prosecution who is the DPP and ruled for the hearing to continue.

“The ruling affirmed DPP’s position that the charges were properly instituted by the Office which has powers to institute criminal charges under Article 157 of the Constitution,” DPP stated.During a hearing on 3rd March 2022, the case had been postponed to June 13 and 14 this year, after Rotich’s lawyer Kioko Kilukumi reportedly fell ill.

In the said fraud case, Rotich is accused of misappropriation of public funds relating to the construction of the Arror and Kimwarer Multipurpose Development Dam Projects. 

Rotich and four others have also been charged jointly with a variety of offences ranging from conspiracy to defraud, abuse of office, and failure to comply with various sections of the law while carrying out contracts that required the Kenyan government to pay approximately Ksh.63 billion for the construction of the two dams. The case will be heard on 28th March 2022.
