Faith Mwikali Ndiwa in Court Over Alleged KEMSA Contract Fraud

In court on Monday this week, Faith Mwikali Ndiwa faced accusations of forging a framework contract under the Kenya Medical Supplies Authority (KEMSA) for the procurement of long-lasting insecticidal nets.

KEMSA holds a pivotal role in Kenya’s public health infrastructure, overseeing the procurement and distribution of medical supplies to ensure adequate healthcare provisions nationwide.

Ndiwa’s alleged involvement in fraudulent activities raises significant concerns regarding transparency and accountability in public health procurement. Prosecutors claim she forged a contract amendment between KEMSA and Ashley Dylan Limited on March 7, 2022, intending to defraud KEMSA of substantial funds.

The alleged forgery, purportedly conducted at an undisclosed location within Kenya, aimed to divert vital funds from KEMSA meant for procuring essential medical supplies. This poses not only a financial loss but also jeopardizes public health services.

In addition to forgery, Ndiwa faces a fraud charge for allegedly obtaining over Sh25 million from Jude Olabayo Veracruz under false pretenses of securing a KEMSA contract for her company, Ashley Dylan Limited.

Ndiwa maintains her innocence, awaiting a bail hearing after being remanded in custody by Chief Magistrate Susan Shitubi. Her case, drawing significant attention, underscores the severe legal consequences and broader ramifications of fraudulent activities.

KEMSA has reaffirmed its commitment to transparency and accountability, likely to enforce stricter measures to prevent future fraud and safeguard public health funds.

The public’s reaction reflects concerns for stricter oversight and accountability within public health procurement, given the critical importance of long-lasting insecticidal nets in combating malaria, a major health issue in Kenya.
