Kibera Law Courts Principal Magistrate Hon. Zainab Abdul has sentenced four men to 30 years imprisonment after they were found guilty of gang defiling a 14-year-old girl, contrary to Section 10 of the Sexual Offences Act of 2006.
The four men—Emmanuel Mutemi, Kennedy Irungu, Peter Mwaura, and Ben Thuo—were found guilty of gang defiling the 14-year-old girl in the Laini Saba area of Kibera on the eve of the new year in 2022.
The court heard the victim’s testimony that she and her friend went for a night vigil on December 31, 2021, to usher in the new year. After the service ended, they headed home at midnight on January 1, 2022. It was at this time that they were accosted by a group of men. Her friend managed to escape, but she was cornered.
She recounted that the men took her to a nearby abandoned mud house and took turns defiling her from midnight until daybreak.
She further testified that they threatened to slit her throat if she tried to scream for help. The victim managed to identify the perpetrators through the illumination of street lights and recognized them as people she saw daily in the neighborhood.
In her judgment, Hon. Abdul stated that the prosecution, represented by Fridah Kainga and Maureen Tanui, proved the case beyond a reasonable doubt through the testimonies of nine prosecution witnesses. These testimonies and the exhibits presented in court placed the four men at the scene of the crime.
The magistrate also noted that the offense of defilement has become rampant in Kibera, emphasizing that the sentence should serve as a deterrent to others who might contemplate such actions.
