The High Court has prolonged its injunctions preventing Businesswoman Dorcas Joan Kiptoo from interfering with a valuable piece of land in Karen valued at Ksh.4.6 billion.
Concurrently, a fresh motion has been lodged in court, seeking to hold Kiptoo in contempt for defying the court’s orders.
During Monday’s session presided over by Justice Ogutu Mboya, it was disclosed that Kiptoo had disregarded the court orders issued on March 8, with respondents proceeding to fence the property as instructed.
Likewise, it was revealed to the court that law enforcement, particularly the police, had failed to adhere to the directives, prompting the plea to prioritize the contempt application over other matters.
“The previous orders were unequivocal, the OCS Karen was to assist in enforcing the orders and their failure to comply warrants prioritizing the contempt application and the ongoing contempt entails fencing off the land,” the court was informed.
“They are shielding the defendants. We urge the court to inspect the disputed land and provide directives and orders,” the court was further apprised.
In the application, Arvind Kanji Patel asserts there is a deliberate and willful defiance of the court order by Kiptoo, the Sub County Police Commandant, Karen, and the OCS Karen Police station.
“It is imperative for the court to incarcerate the contemnors to ensure compliance with the court order,” the court documents state.
The judge instructed that the application be heard on May 6 of this year, directing all parties to submit their respective documents and arguments within seven days.
