Milimani Children’s Court Principal Magistrate Hon. Jackie Kibosia has handed down a conviction and sentencing in a case of child pornography, ordering a middle-aged woman to either pay Ksh 15 million or serve 5 years in prison.
The defendant, Sharon Wabwile, who was employed as a househelp at the time of the offense, was found guilty on all three counts. During the sentencing hearing, the prosecution, represented by Victor Preston Owuor, highlighted the emotional trauma suffered by the victim and requested compensation under Section 26 of the Victim Protection Act.
According to the court proceedings, the defendant, entrusted with the care of the seven-year-old victim, took multiple photographs of the child while she was asleep and shared them with her boyfriend, who had requested the defendant’s nude images.
In addition to the fine, the court ordered the defendant to pay a restitution amount of Kshs. 2 million to the victim, prioritizing this payment over the fine. If unable to meet this obligation, the victim is entitled to claim the amount through the Victim Protection Trust Fund.
Furthermore, the court mandated the removal of the images from all social, print, and visual media platforms. Additionally, the phone used to capture the images was to be forfeited to the Communications Authority of Kenya.
