The Judiciary has raised concerns over a statement issued by the Law Society of Kenya (LSK) on January 23, 2025, calling on its members to occupy the Supreme Court.
The planned protest is in response to a decision by the Supreme Court to recuse itself from hearing matters related to Senior Counsel Ahmednasir Abdullahi and his law firm.
In a press statement released on January 27, 2025, the Judiciary highlighted that this matter is before multiple courts, including the East African Court of Justice, the Court of Appeal, and the High Court.
Already the Law Society of Kenya v Supreme Court of Kenya & Another has a petition at the Constitutional and Human Rights Division of the High Court while Ahmednasir Abdullahi Advocates LLP & 10 Others v. Lady Justice Martha Koome & 9 Others – A case also before the High Court.
Additionally, Ahmednasir Maalim Abdullahi v. Attorney General of Kenya – A reference before the East African Court of Justice while the Supreme Court of Kenya & 9 Others v. LSK & 12 Others – A civil application at the Court of Appeal.
The Judiciary clarified that the recusal of Supreme Court judges from these matters was based on concerns about fairness and impartiality, given that the cases involve Ahmednasir Abdullahi, who has made public statements against the court.
