Renowned legal practitioner, Ndegwa Njiru, offered illuminating perspectives following a cross-examination of the NADCO report, shedding light on pivotal issues concerning electoral processes and legal frameworks.
Addressing a gathering convened to deliberate on bills before the National Assembly, Wakili Njiru underscored the significance of reviewing the NADCO report to address challenges arising from previous general elections.
Central to the discussion was the question of server hosting for Presidential elections.
Njiru raised concerns about the jurisdiction and legal implications should servers be hosted abroad, akin to previous elections in Venezuela.
“I advocate for domiciling servers within Kenya to ensure immediate application of Kenyan law in the event of electoral offenses.” He said
Lawyer Njiru highlighted the ambiguity surrounding the quorum for declaring Presidential election results. Proposing a definitive quorum, he suggested that the seven-member Commission should be responsible for result declaration, with the announcement entrusted to a single individual to delineate between declaration and announcement.
Njiru also emphasized the pivotal role of the Independent Electoral and Boundaries Commission (IEBC) in ensuring transparent and secure elections. He proposed gazetting every polling station as a police station to bolster security and enhance voter confidence, crucial for upholding democratic principles.
” I also advocated for stringent regulations against party hopping, asserting that elected officials should not switch political affiliations without resigning first, aiming to fortify the integrity of political processes.”
