A woman, whose identity is being safeguarded for her safety, has initiated a legal action against Healthy U 2000 Limited Company, alleging wrongful termination from her employment following her rejection of inappropriate sexual advances from the company’s operations manager, Hillary Oyando.

Confidential documents obtained from the Employment and Labour Relations Court have uncovered troubling messages sent by Oyando to the woman.

In one message, Oyando stated, “I feel you, you are too far from me, Jikaze beb it’s gonna be well, I like your bending now.” These explicit messages provide disturbing insight into the manager’s misconduct toward the employee.

Evidence presented in the court documents strongly suggests that the woman, referred to as Monica, not her real name , did not receive a fair hearing before her dismissal.

It is alleged that Oyando contrived charges against her, ultimately leading to her termination. Disturbingly, it is implied that had she acquiesced to Oyando’s advances, she might have retained her job.

A prominent city lawyer, representing the woman, argued,

“Our client was denied a fair hearing, subjected to sexual harassment, and her rights were violated.” The lawyer further asserted that Monica (not her real name)  possessed a valid employment contract dating back to 2019 and was unjustly dismissed.

One of the allegations leveled against Monica was related to the loss of loyalty points at the ABC place where she was employed.

However, court documents suggest that her inability to address the issue stemmed from ongoing sexual harassment she endured in the workplace.

It is noteworthy that Monica was known to work at high-profile locations such as Sarit Centre and Two Rivers Mall, amplifying the significance of her unfair dismissal case.

The woman’s legal representative is now seeking remedies from the court. They are requesting the court to declare her termination illegal, acknowledge her as a victim of sexual harassment by the manager, and order the company to pay her the full salary amounting to Sh1.5 million owed to her.

These allegations underscore the importance of fostering safe and respectful workplaces. This case is expected to set a precedent for how companies address such sensitive matters and the repercussions they may face for failing to protect their employees’ rights.

The court documents also reveal that the woman has been summoned by the police from Muthangari Police station on multiple occasions, underscoring the gravity of the allegations and the legal battle ahead.
